Terms and Conditions

1. Introduction & Acceptance

These Terms and Conditions ("Terms") govern your use of Sampo, operated by PONT Inc. ("PONT," "we," "us"). By using the App, you agree to these Terms. Sections 11, 12, 14, and 15 contain important limitations on your legal rights, including a disclaimer of warranties, a limitation of liability, a binding arbitration agreement, and a class action waiver.

2. Definitions

• "Points" are in-app units with no cash value, not a currency, security, or crypto-asset.
• "Target Digital Assets" refers to digital assets that may be made available through the App's reward mechanics.
• The App's "Wallet" is non-custodial — PONT never holds or controls your private keys.
• "Third-Party Service" refers to any advertising, offerwall, or other service integrated into the App but operated by a third party.

3. Eligibility

You must be at least 13 years old to use the App; users under the age of majority in their jurisdiction require parental or guardian consent. You may not use the App if you are on any sanctions list maintained by OFAC or a similar body, or if you have previously been banned from the App.

4. Account Registration

You must register using a supported sign-in method (Apple or Google) and provide accurate information. You are responsible for maintaining the security of your account.

5. Points & Rewards

Points are earned through in-App activities including walking, watching video ads, completing missions, leveling up your pet, and inviting friends, subject to daily caps. Points expire after 180 days of inactivity. Exchanging Points requires a minimum account tenure of 5 days / 120 hours, one-time SMS verification, and, above certain thresholds, identity verification (KYC). Points have no cash value outside the App's reward mechanics.

6. Target Digital Assets / Wallet

Exchanging Points for Target Digital Assets is a redemption for a data/reward service, not a sale of securities or a money transmission service. Target Digital Assets may be issued by third parties. You acknowledge the risks inherent in digital assets, including price volatility and irreversibility of transactions.

7. Non-Custodial Design

The App's wallet is non-custodial. We cannot recover your wallet, private keys, or funds if lost. Blockchain transactions are irreversible.

8. User Conduct & Prohibited Activities

You may not use bots, scripts, GPS spoofing, VPN/proxy location evasion, multiple accounts, or fraudulent invite schemes to gain an unfair advantage or manipulate rewards.

9. Intellectual Property

All content and trademarks in the App belong to PONT or its licensors. We respond to valid DMCA takedown notices.

10. Termination

We may suspend or terminate your account for violation of these Terms, fraud, or abuse, at our discretion.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PONT'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) US$100 OR (B) THE AMOUNT YOU PAID TO PONT IN THE 6 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold PONT harmless from claims arising out of your violation of these Terms or misuse of the App.

14. Dispute Resolution & Binding Arbitration

Any dispute arising out of these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA), seated in Delaware. You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms.

15. Class Action Waiver

You agree to resolve disputes with PONT only on an individual basis, and waive any right to bring or participate in a class, collective, or representative action.

16. Governing Law

These Terms are governed by Delaware and U.S. federal law. Any litigation not subject to arbitration shall be brought exclusively in the courts of New Castle County, Delaware.

17. Changes to These Terms

We may modify these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance.

18. General Provisions

These Terms constitute the entire agreement between you and PONT. If any provision is held unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our consent. The English-language version of these Terms controls in the event of any conflict with a translation.
